Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

  • ‘You’, ‘Your’ refers to the user of the Lutore Apartment app.
  • ‘Content’ refers to any text, images, or other material users may post or upload to our app.

1. Acceptance of Terms

By using the Lutore Apartment app, you agree to these terms and conditions. If you do not agree to these terms, you should not use this app.

2. User Responsibilities

As a user, you are responsible for maintaining the security of your account and for the content you create. You agree not to share your account details with others or allow others to access your account. You are solely responsible for all activities that occur under your account.

You may not use the app for any illegal or unauthorized purpose. You agree not to post content that is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.

All content and services provided through the app, excluding content created by users, are the property of Lutore Apartment. This includes, but is not limited to, the app’s design, software, text, images, graphics, and all other material contained in the app.

5. User Content

Users retain ownership of the content they create. However, by posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods (now known or later developed). You agree that you own or have the necessary rights to all of your content.

6. Termination

We reserve the right to terminate or suspend your account at any time without notice or liability, for any reason, including but not limited to a breach of these terms. Upon termination, your right to use the app will immediately cease. All the data related to your account will be frozen and can be deleted at any time by the company itself, without having to ask you beforehand.

7. Changes to Terms

We reserve the right to modify or replace these terms at any time. If a revision is material, we will notify you through the email address you provided during registration.

Our app may contain links to third-party websites or services that are not owned or controlled by Lutore Apartment. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

9. Limitation of Liability

In no event shall Lutore Apartment, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the app.

10. “AS IS” and “AS AVAILABLE” Disclaimer

The app is provided to you “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. We do not warrant that the app will meet your requirements, achieve any intended results, be compatible, or work with any other software, applications, systems, or services, operate without interruption, meet any performance or reliability standards or be error-free, or that any errors or defects can or will be corrected.

11. For European Union (EU) Users

If you are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident in.

You represent and warrant that you are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a “terrorist supporting” country, and that you are not listed on any United States government list of prohibited or restricted parties.

13. Governing Law

These terms shall be governed and construed in accordance with the laws of Germany, Europe, without regard to its conflict of law provisions.
